Traveling While Out On Bail: Is It Possible?

Things happen in life; the fact that you are out on bail pending a criminal charge does not change this idea. However, if this emergency involves a trip out of town, the fact that you are out on bail does change how you can respond to the situation. To determine whether or not you can travel while you are out on bail, you first need to look at your release agreement. Generally, your criminal history and the type of charge that you face will largely determine if you have travel restrictions. For example, some with a criminal history and a current charge of attempted murder would be more likely to have travel restrictions than someone facing a DUI charge. 

Circumstances Matter

It is also important to note that the circumstances surrounding the travel plans also matter. For example, even if there are travel restrictions imposed on the bail release, an individual may be able to get a compassionate waiver if the reason for the travel is important, such as to attend the burial of a parent or child. On the other hand, a travel request for a family vacation may not get authorized.

Bail bond companies can have overlays, or additional restrictions, that they impose on the bond agreement that is aside from those imposed by the court, including travel restrictions without proper notification or approval. Travel Limitations

In some instances, there are limitations on travel that cannot be moved, and one of these limitations is international travel. It does not typically matter the reason you are traveling outside the country — it is not tolerated. The concern with this type of travel is that the individual could jump bail and retreat to a country without extradition. International travel is commonly banned by the courts and bail bond agencies alike.
